    Last Will and Testament

    A Will is the most common and essential estate planning tool for many individuals and determines what will happen to your property and assets upon your death. Generally, having a Will protects you to ensure your assets are distributed according to your wishes. Your Will is drafted to outline who you would like to receive specific property and assets and you can select a trusted individual to serve as your executor.

    Without a Will, you will be deemed to have died intestate and your estate will follow the State of Texas’ default rules. This results in a lengthier and more costly probate process for your family and may potentially result in undesirable individuals to receive part or all of your estate.

    What Is Probate?

    Probate is a legal procedure often required after an individual dies. During probate, the deceased person’s Will is validated by the Court, and the named or agreed upon executor is appointed to follow the instructions included in the Will and distributes assets.

    What Happens During Probate?

    During probate, the deceased individual’s creditors have an opportunity to file claims against the estate for any debts owed by the deceased individual. After these claims have been paid, the remaining assets are distributed to heirs designated in the will. If no will exists, these assets will be distributed according to Texas law.
